Terms of Use
SIMMER APP & WEBSITE
Version 2.0 | Last Updated: October 19, 2026
Operator: Simmer, Inc., a Delaware corporation doing business in California. Questions: hello@simmerapp.ai.
1. Acceptance and Scope
SIMMER provides financial education through interactive lessons, games, virtual rewards and optional planning tools. These Terms of Use ("Terms") govern your use of the SIMMER mobile application, website and related features. By creating an account or accepting these Terms, you agree to them and acknowledge our Privacy Policy. If you do not agree, do not use SIMMER. Organizations that sponsor learners may have a separate agreement with SIMMER governing their services and access.
SIMMER's app is currently distributed in the United States. You must comply with laws that apply where you use it. Certain features or purchase options may not be available to all users or in all locations.
2. Eligibility and Account Security
2.1 Age eligibility
The standard SIMMER experience is intended for individuals aged 13 or older. Children under 13 must not open a standard account. Users under 18 may access age-appropriate features, subject to applicable laws, institutional rules, and any parental or guardian approval required by an app store or law. We do not impose a universal SIMMER-only parental consent form for every 13–17-year-old, but this does not override requirements applicable in particular states. Where a platform supplies legally required age-category or parental-permission information, we may rely on it to apply required protections and restrictions. An under-13 account brought to our attention may be suspended or deleted in accordance with applicable law.
2.2 Registration
You may register using supported email/password or Apple or Google sign-in. Provide information you are authorized to provide, protect your credentials, and notify us promptly if an account appears compromised. The onboarding age-range question is optional and is not a substitute for legally required age verification. No learner phone number is required. Registering involves acknowledging the Terms and Privacy Policy; any newsletter election is separate and optional.
3. Personal and Sponsored Experiences
3.1 One application, different entitlements
SIMMER has a personal-user experience and an organization-sponsored experience within the same app. After verification of an email address on an approved institution domain, SIMMER may connect your account to the sponsoring organization and any assigned class or group. Authorized school or organizational personnel may see your institution-related learning progress and class activity, as described in the Privacy Policy and applicable institutional agreement.
3.2 Sponsored users and diamonds
While you have an active sponsored student entitlement, you may earn and redeem eligible virtual diamonds in the SIMMER Store, but you cannot purchase real-money items, purchase diamonds for money or obtain a personal paid subscription through the sponsored account. This applies to lives, streak savers and other items offered for payment. Diamond spending is distinct from purchasing items with real money.
3.3 When organization sponsorship ends
When an organization stops sponsoring access, SIMMER may offer learners a way to continue using their existing SIMMER account independently. Depending on the options available at that time, this may include a free experience or optional paid features or subscriptions if introduced. We will disclose the available features and payment terms before any separate purchase. The end of sponsorship does not itself enroll anyone in a paid plan or authorize charges.
Eligible personal account information and learning progress may remain associated with the account, subject to applicable laws, technical limitations and institutional agreements. Available features and access to saved information may change when sponsorship ends. School-controlled records, including rosters, assignments, grades and institution-directed communications, remain subject to the organization's instructions and applicable law and do not automatically transfer into a personal account. If a school-managed email becomes unavailable, continuing access may require updated sign-in details and verification. Users may request deletion of eligible personal information under the Privacy Policy.
4. Virtual Rewards and Purchases
4.1 In-app rewards
SIMMER may provide diamonds, lives, streaks, badges and similar digital features to support learning. Diamonds are virtual items with no cash, banking or investment value; they cannot be exchanged for cash or transferred outside SIMMER. The app may adjust reward mechanics or availability for reasonable product, integrity or compliance reasons, subject to applicable law and any required notice.
4.2 One-time purchases
Eligible personal users can choose to purchase lives, streak savers or other clearly identified one-time digital items through the native Apple App Store or Google Play checkout. The platform processes payment, determines the final displayed price (including applicable taxes), and handles refund requests according to applicable store rules and nonwaivable consumer rights. SIMMER uses RevenueCat to support purchase recognition. We do not receive your full payment-card details.
Personal users aged 13–17 may make eligible purchases only when permitted by applicable law and app-store rules. Parental or guardian approval may be required for certain users or purchases, depending on state requirements and platform settings. A purchase cannot proceed where a legally required authorization has not been obtained.
4.3 Possible future Premium subscriptions
SIMMER does not currently operate a live recurring subscription or Premium paywall. If introduced, a subscription will be offered through an authorized checkout that explains price, billing frequency, renewal, any trial-to-paid conversion, key benefits, feature limitations and cancellation instructions before you affirmatively buy it. Signing up, accepting a no-cost promotional period, continuing on Free, or leaving a school program does not by itself authorize a charge. If you purchase a subscription in the future, manage or cancel it through the appropriate app-store account settings, subject to the instructions shown at purchase and applicable law.
5. Educational Nature of the Service
SIMMER provides general financial education, illustrations, games and calculations—not individualized investment, credit, tax, legal or financial advice. SIMMER is not acting as your bank, lender, broker, financial adviser or insurance provider through these features. Budget, savings, debt and retirement outputs depend on user-provided inputs, assumptions and market conditions, and do not guarantee outcomes. For significant decisions, consider consulting an appropriately qualified professional.
6. User Conduct and Content
Do not impersonate another person, provide false school affiliation, abuse other users, upload unlawful material, circumvent purchase controls, disrupt the app, improperly access records, use automation to scrape protected content or violate another party's rights. Institution-linked messaging, if provided, is intended for authorized instructor/student and support communications rather than general student-to-student messaging.
You retain ownership of photographs, messages and other materials you lawfully provide. You grant SIMMER a limited, nonexclusive, royalty-free license to store, process, display and transmit that material to authorized recipients solely to provide, secure and support the relevant SIMMER feature. This permission ends to the extent eligible material is deleted, subject to lawful retention and institution recordkeeping. You are responsible for having permission to upload the material.
7. Privacy and Student Records
SIMMER's Privacy Policy explains how personal information is collected, used, shared and deleted. Authorized organization personnel can access institution-related educational records according to their assigned roles. Private values you enter voluntarily into financial tools for personal planning are not disclosed through the institution Admin Portal. Where SIMMER processes school-controlled records, institutional agreements and applicable laws (including FERPA where relevant) control their use and disposition.
8. Access Restrictions, Termination and Account Deletion
You can request deletion of your personal account through the in-app Delete Account path or through the account-deletion contact or web resource identified in SIMMER's Privacy Policy. SIMMER will verify and process eligible deletion requests, including associated personal data, subject to legitimate legal and institutional retention obligations. Ending school sponsorship is different from deleting your personal account.
SIMMER may suspend or restrict accounts for security threats, fraud, unlawful activity, misuse, or material breaches of these Terms. We may change or discontinue services with notice as required by law. Where access is discontinued, rights to legally retained or institution-controlled information will continue to be handled under the Privacy Policy and applicable law.
9. Intellectual Property
SIMMER and its licensors retain ownership of SIMMER branding, characters, lessons, games, source code and original product content. Subject to these Terms, you have a limited, revocable, nonexclusive, nontransferable license to access the service for lawful personal or authorized sponsored educational use. Other uses require permission unless independently allowed by law.
10. Service Availability and Limitations
SIMMER is provided for educational use on an "as available" basis. To the extent permitted by law, we do not guarantee uninterrupted availability, error-free operation, accuracy of calculations or specific learning or financial results, and disclaim warranties not expressly required by law. To the extent permitted by law, SIMMER is not responsible for indirect, incidental, special or consequential losses arising from use of the service. Nothing in these Terms limits liability or rights that cannot lawfully be limited, including liability for intentional wrongdoing, nonwaivable consumer protections or other statutory remedies.
11. Governing Law and Disputes
These Terms are generally governed by the laws of California, without regard to its conflicts-of-laws rules, except where another jurisdiction's mandatory consumer or student protections apply. Disputes that cannot be resolved informally may be brought in a state or federal court with lawful jurisdiction. Nothing in this section requires a minor to waive an otherwise available right to disaffirm a contract, or deprives a user of any mandatory consumer protection or legally available venue. These Terms do not impose mandatory arbitration or a class-action waiver.
12. Changes and Contact
We may revise these Terms as SIMMER's features or legal obligations change. We will update the Last Updated date above and provide notice or seek renewed acceptance and parental approval where required by law. The version of these Terms presented when you accept them identifies the terms applicable to your account, subject to applicable law.
